Omnilex-Zusammenfassung

The Federal Supreme Court declared the spouses’ complaint inadmissible because it did not engage with the cantonal constitutional court’s reasoning and therefore failed the substantiation requirement of Art. 42(2) BGG. The Court applied the simplified non-entry procedure under Art. 108(1)(b) BGG. It waived court costs under Art. 66(1) BGG, which made the request for free legal aid moot. The underlying dispute concerned the refusal of a naturalization request by the Basel civic commune for lack of integration.

Omnilex-Regeste

Art. 42 Abs. 2 BGG; Art. 108 Abs. 1 lit. b BGG; requirements for the reasoning of a federal complaint and non-entry in simplified procedure. A complaint must, in a concise but substantiated manner, address the decisive reasons of the challenged decision and show in what respect federal law is allegedly violated. Merely repeating the party’s own view or failing to engage with the cantonal reasoning is insufficient. If the substantiation requirement is manifestly not met, the Federal Supreme Court may refuse entry under the simplified procedure without examining the merits (consid. 2). Where no costs are imposed pursuant to Art. 66 Abs. 1 BGG, a request for free legal aid becomes moot.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the federal complaint was sufficiently reasoned under Art. 42(2) BGG.

Extrahierter Entscheid

No. The appellants did not engage with the cantonal court's reasoning and therefore failed to show how the challenged judgment violated federal law.

Extrahierte Begründung

A complaint must concisely explain which rights were violated; absent any substantive confrontation with the cantonal reasoning, the requirement of reasoned argumentation is not met.

Kernrechtsfrage

Whether the complaint had to be examined in ordinary proceedings despite the deficient reasoning.

Extrahierter Entscheid

No. Because the complaint was insufficiently reasoned, the Court could dispose of it under the simplified procedure of Art. 108(1)(b) BGG.

Extrahierte Begründung

A manifestly inadequately reasoned filing permits non-entry without full merits review.

Kernrechtsfrage

Whether court costs should be charged and free legal aid examined.

Extrahierter Entscheid

No costs were charged; the request for free legal aid became moot.

Extrahierte Begründung

Given the non-entry and the decision to waive costs, no cost order was made.
