Omnilex-Zusammenfassung

X.________ challenged a notice of surveillance measures issued by the Federal Prosecutor's Office. He first appealed to the Federal Criminal Court and, because he doubted its jurisdiction, filed a parallel protective appeal with the Federal Supreme Court. After the Criminal Appeals Chamber of the Federal Criminal Court confirmed its jurisdiction and dismissed the complaint on 6 June 2011, the Federal Supreme Court held that the parallel appeal was not admissible. It declined to enter into the matter and waived court costs.

Omnilex-Regeste

Art. 108 Abs. 1 lit. a BGG; direct appeal inadmissible where the complained-of measure has already been subjected to a competent lower appellate decision and the Federal Supreme Court is seized only on a precautionary basis. A party may not circumvent the ordinary appellate route by filing a parallel protective appeal. If the lower appellate authority has confirmed its jurisdiction, entered into the matter, and decided the complaint, the Federal Supreme Court will not entertain the duplicate appeal; costs may be waived under Art. 66 Abs. 1 BGG.

I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Fonjallaz, Präsident,
Gerichtsschreiber Pfäffli.

Verfahrensbeteiligte
X.________, Beschwerdeführer, vertreten durch Fürsprecher Alexander Feuz,

gegen

Bundesanwaltschaft, Taubenstrasse 16, 3003 Bern.

Gegenstand
Mitteilung von Überwachungsmassnahmen,

Beschwerde gegen die Mitteilung von Überwachungsmassnahmen vom 24. März 2011 der Bundesanwaltschaft.
In Erwägung,
dass X.________ gegen die Mitteilung von Überwachungsmassnahmen der Bundesanwaltschaft vom 24. März 2011 mit Eingabe vom 4. April 2011 Beschwerde bei der I. Beschwerdekammer des Bundesstrafgerichts eingereicht hat;
dass X.________ die Zuständigkeit der I. Beschwerdekammer als zweifelhaft erachtete (Sprungrekurs direkt an das Bundesgericht) und deshalb zur vorsorglichen Fristwahrung eine gleichlautende Beschwerde beim Bundesgericht eingereicht hat;
dass die I. Beschwerdekammer des Bundesstrafgerichts mit Beschluss vom 6. Juni 2011 seine Zuständigkeit bejaht hat, auf die Beschwerde eingetreten ist und diese als unbegründet abgewiesen hat;
dass somit auf die vorsorglich beim Bundesgericht eingereichte Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. a BGG nicht einzutreten ist;
dass auf eine Kostenauflage verzichtet werden kann (Art. 66 Abs. 1 BGG);

Kernrechtsfrage

Whether the Federal Supreme Court could hear the appeal directly despite the pending jurisdictional question before the Federal Criminal Court.

Extrahierter Entscheid

The appeal was not admissible before the Federal Supreme Court because the competent lower appellate chamber had already ruled and rejected the complaint.

Extrahierte Begründung

The complainant filed the same challenge with the Federal Supreme Court only as a precaution. Since the I. Criminal Appeals Chamber of the Federal Criminal Court had confirmed its jurisdiction, entered into the case, and dismissed the complaint as unfounded, there was no basis for a direct appeal to the Federal Supreme Court.
