The appellant withdrew her administrative law appeal against the Federal Public Prosecutor’s refusal of mutual legal assistance to Italy. The President of the First Public Law Court took note of the withdrawal and ordered the case struck from the docket. Because the withdrawal came only after preparation of the case and exchange of submissions, a reduced court fee of CHF 500 was charged to the appellant.
Art. 40 OG; Art. 73 cpv. 1 PC; withdrawal of appeal terminates the proceedings and entails striking the case from the docket. considerato:
che con scritto del 12 febbraio 2004 il Ministero pubblico della Confederazione ha respinto un'istanza di A.________;
che avverso tale comunicazione l'istante, in data 26 febbraio 2004, ha inoltrato un ricorso al Tribunale federale;
che con lettera del 25 marzo 2004 la ricorrente ha dichiarato di ritirare il ricorso;
che, in applicazione degli art. 40 OG e 73 cpv. 1 PC, la desistenza termina il processo e la lite dev'essere stralciata dai ruoli;
che in caso di desistenza il Tribunale federale può rinunciare, in tutto o in parte, alla riscossione delle spese processuali (art. 153 cpv. 2 OG) e che il giudice delegato decide sulle spese e ripetibili (art. 40 OG in relazione con l'art. 5 cpv. 2 secondo periodo PC);
che il ritiro essendo intervenuto dopo l'istruzione della causa e lo scambio degli scritti, si giustifica di riscuotere una tassa di giustizia ridotta;
decreta:

Si prende atto del ritiro del ricorso e la causa 1A.55/2004 è stralciata dai ruoli.
2.
La tassa di giustizia di fr. 500.-- è posta a carico della ricorrente.
3.
Comunicazione ai patrocinatori della ricorrente, al Ministero pubblico della Confederazione e all'Ufficio federale di giustizia, Divisione dell'assistenza giudiziaria internazionale in materia penale (B 140 657).

The court took note of the withdrawal and struck the case from the docket.
Under Arts. 40 OG and 73(1) PC, withdrawal terminates the proceedings and the case must be removed from the docket.
How to allocate court costs after the withdrawal of the appeal.
A reduced court fee of CHF 500 was imposed on the appellant.
Because the withdrawal occurred after the case had been prepared and the exchange of written submissions had taken place, a reduced fee was justified; the court may waive costs in whole or in part under Art. 153(2) OG.
