The measure was a special surveillance at the access-provider level because monitoring at the service-provider level was impossible for collusion reasons. Under Art. 16 BÜPF, the ordering authority must compensate costs of the individual surveillance. The old fee regulation contained no flat fee for email surveillance, so the DBA was entitled to determine compensation by workload.
