Schärer und Comp. sought federal review of a Lucerne High Court judgment acquitting Fritschi and Woodtli in a trademark-related police criminal case. The Federal Court held that the judgment was purely criminal and decided no civil claims. Because Arts. 29 and 30 OG provide a federal remedy only against cantonal civil judgments, and Arts. 18-20 of the Trademark Act do not create appellate jurisdiction over cantonal criminal judgments, the complaint was not entered upon.
Arts. 29-30 OG; admissibility of federal appeal against cantonal criminal judgments in trademark matters. The remedy under Arts. 29 and 30 OG is confined to civil judgments rendered by cantonal courts. A cantonal judgment which resolves only the penal aspect of a trademark infringement case is not amenable to this federal remedy, even if the underlying dispute concerns federal trademark law. The substantive and procedural rules of the Trademark Act do not by themselves establish Federal Court jurisdiction as appellate instance over cantonal criminal decisions (consid. 1).
ten Gesetzesbestimmungen vorgesehene Rechtsmittel nur gegen Civilurtheile der kantonalen Gerichte, dagegen keineswegs gegen Strafurtheile statthaft. Die Art. 18 bis 20 des eidgenössischen Markenschutzgesetzes, auf welche die Rekurrenten im Weitern Bezug genommen haben, vermögen hieran nichts zu ändern. Denn dieselben stellen wohl bundesrechtliche Normen des ma teriellen und Prozeßrechtes auf, enthalten dagegen durchaus keine Bestimmung, wodurch das Bundesgericht als obere Instanz gegenüber kantonalen Strafurtheilen in Markenrechtssachen er klärt würde. Demnach hat das Bundesgericht erkannt: Auf die Beschwerde wird nicht eingetreten.
