The mother of an out-of-wedlock child challenged a Lucerne cantonal decision ordering guardianship over the child. The Federal Court held that the relevant Civil Code provisions do not grant a parent a subjective right to custody in such a case. Because the complaint relied only on the child’s welfare and not on a directly vested personal right, the requirements for a constitutional complaint under Art. 88 OG were not met. The complaint was therefore inadmissible.

The Civil Code provisions governing the status of an illegitimate child do not confer on either parent a subjective right to be entrusted with parental authority. A parent contesting a refusal, withdrawal, or alternative guardianship measure invokes primarily the child’s interests; such an interest may justify supervisory remedies under the ZGB, but it does not constitute a direct impairment of the complainant’s own rights within the meaning of Art. 88 OG. Consequently, a constitutional complaint by a parent or third party against a cantonal guardianship supervisory decision is inadmissible absent an immediately vested right of the complainant (consid. 2).

Es wird beantragt, den Entscheid des Regierungsrates aufzuheben, weil die Nichteinräumung der elterlichen Gewalt an die Beschwerdeführerin willkürlich sei und das Verbot rechtsungleicher Behandlung verletze.
Die Beschwerde gegen die Anordnung der Vormundschaft über das Kind Walter Kesselring ist somit mangels Legitimation der Beschwerdeführerin unzulässig.
