Le recourant allègue que l'art. 397 CP interdit au juge qui doit se prononcer sur le fond, lorsque la revision a été admise en principe, de revoir l'ensemble des circonstances de la cause et l'oblige à s'en tenir "aux seuls éléments nouveaux et sérieux dont l'existence a été reconnue judiciairement".

Cette thèse est erronée. L'art. 397 CP ouvre au condamné la voie de la revision en matière pénale dans certains cas qu'il prévoit. Mais, cette voie ayant été ouverte devant les autorités cantonales, comme elle l'a été en l'espèce, le droit fédéral ne prescrit rien de plus; la procédure en particulier demeure réservée au législateur cantonal (RO 69 IV 137). Celui-ci peut en principe régler comme il l'entend le pouvoir d'examen du juge, l'autoriser notamment à revoir l'ensemble de la cause, à ne pas s'en tenir exclusivement aux données du jugement revisé et aux seules modifications qu'imposent les faits nouveaux, justificatifs de la revision (cf. CLERC, De la procédure en matière de revision, dans la Festgabe zum 70. Geburtstag von Ernst Hafter, RPS t. 61, p. 246).

Le recourant objecte que le juge qui se prononce à nouveau pourrait, dans ce cas, aller jusqu'à infliger à l'instant une peine plus sévère que celle du jugement annulé par la revision, ce qui serait incompatible avec le droit fédéral. Il n'est pas nécessaire d'examiner en l'espèce si tel est bien le cas; la question ne se pose pas, puisqu'au lieu d'aggraver la peine, le nouveau juge l'a adoucie (quatorze mois d'emprisonnement au lieu de quinze).
