Karl Beeler was convicted by the Kreisgericht Churwalden of instigating an impossible attempt at abortion after inducing Hildegard Gander, who was apparently not pregnant, to ingest a liquid intended to terminate a pregnancy. The Cantonal Court Committee of Graubünden rejected his complaint. On cassation, Beeler argued that an impossible attempt is punishable only when either the means or the object is unsuitable, not when both are unsuitable. The Federal Court rejected this reading of Article 23 StGB and held that the provision does not exclude punishment in such a case; it merely allows mitigation, while complete abstention from punishment is reserved for lack of understanding under Article 23(2) StGB.

Article 23(1) StGB, by referring disjunctively to the unsuitability of the means or the object, governs only the court’s power of mitigation and does not establish a negative requirement that liability lapses if both are unsuitable. The statute contains no basis for excluding punishment in such a case; at most, the court may reduce the penalty. Only where the offender acts out of lack of understanding may the court refrain from punishing under Art. 23(2) StGB (consid. 2).

A.- Im Sommer 1954 kam es einige Male zwischen Karl Beeler und Frau Hildegard Gander zum Geschlechtsverkehr. Im August 1954 gab Frau Gander ihrer Befürchtung Ausdruck, schwanger zu sein, worauf Beeler eines Nachts mit einer Flasche bei ihr erschien und sie aufforderte, deren Inhalt einzunehmen, um die Frucht abzutreiben. Frau Gander kam der Aufforderung nach. Am folgenden Morgen stellte sich bei ihr eine so starke Blutung ein, dass ein Arzt beigezogen werden musste.
B.- Am 10. Januar 1957 verurteilte das Kreisgericht Churwalden Frau Gander wegen untauglichen Versuchs der Abtreibung durch die Schwangere zu acht Tagen Gefängnis. Beeler bestrafte es wegen Anstiftung zu untauglichem Abtreibungsversuch mit acht Tagen Gefängnis als Zusatz zu der vom Kreisgericht Chur am 16. September 1954 wegen Widerhandlung gegen das MFG, Störung des öffentlichen Verkehrs und fahrlässiger Körperverletzung ausgefällten Freiheitsstrafe von dreissig Tagen Gefängnis. Beiden Angeklagten wurde der bedingte Strafvollzug gewährt.
Eine von Beeler erhobene Beschwerde wies der Kantonsgerichtsausschuss von Graubünden am 21. Februar 1957 als unbegründet ab.
C.- Beeler führt Nichtigkeitsbeschwerde mit dem Antrag, das Urteil des Kantonsgerichtsausschusses sei aufzuheben und die Sache zu seiner Freisprechung an die Vorinstanz zurückzuweisen.
Der Kassationshof zieht in Erwägung:
