Kunz challenged a Bernese judgment that fined him for failing to stamp an emigration contract and ordered payment of the extra stamp fee and costs. Before the Federal Court, he argued that the cantonal stamp duty conflicted with the federal emigration act and violated equality before the law. The Court held that equality does not require uniform taxation throughout Switzerland, only the prohibition of arbitrary unequal treatment. It therefore rejected that part of the complaint. As to the alleged conflict with federal emigration law, the Court held that it lacked jurisdiction because such an administrative dispute belonged to the Federal Council, respectively the Federal Assembly.
Art. 59 OG; equality before the law and federal jurisdiction in matters relating to cantonal taxes on emigration contracts; the constitutional guarantee of equality does not impose uniformity of cantonal taxation throughout the Confederation, but only forbids arbitrary differentiation within legislation and its application. A complaint alleging that a cantonal stamp duty conflicts with federal legislation on emigration agencies is, insofar as it raises an administrative dispute, outside the Federal Court's competence and falls to the Federal Council or Federal Assembly (consid. 1-2).
