The Solothurn municipality appealed a cantonal judgment requiring it to recognize Hermann Leist as a citizen after Burki had acknowledged paternity and later married Regina Leist. The Federal Court held ex officio that it could not review the matter, because the only disputed question was whether paternity and the resulting legitimacy had been proven or disproven. That was a matter of cantonal evidence and procedure, not federal law. The appeal was therefore dismissed at the threshold as inadmissible for lack of jurisdiction.
Art. 29 f. OG; federal appellate jurisdiction is limited to alleged violations of federal law. Questions concerning the proof of facts underlying the applicability of a federal rule, in particular the rebuttal of a paternity presumption arising from acknowledgment and subsequent marriage, are governed by cantonal procedural law and are not reviewable by the Federal Court. Where the complaint attacks only the cantonal court's assessment of evidence and evidentiary refusals for irrelevance, the Federal Court must decline to enter into the appeal for want of competence.
