Hans Kunfermann sought compensation for crop damage caused by cattle on a meadow in Domleschg. The Graubünden Small Council held that the matter belonged to communal field-police authorities and ordered him to bring the claim before the Scheid communal council. The Federal Court held that the demand was a purely civil damages claim and that municipal field-police powers do not confer civil jurisdiction over standalone compensation actions. It therefore found the cantonal decision unconstitutional and annulled it.

A claim for damages caused by animals to privately owned land is, when pursued independently, a private-law compensation action and not a field-police prosecution. The competence to regulate and police field-police matters, including the fixing of tariff-like compensation in minor cases by communal statute, does not by itself transfer civil jurisdiction to communal authorities. Such authorities may at most exercise police jurisdiction over violations or autonomous rule-making competence; standalone damages claims fall within the civil courts. A cantonal referral of such a claim to the commune violates the guarantee of the lawful judge (consid. 1-3).

Gesetzgebung hier nicht um einen Civilprozeß, sondern um eine Administrativsache, welche zur Kompetenz der Gemeindebehörden gehöre; in diesem Sinne habe sich denn auch der Kleine Rath fortwährend, insbesondere in einer Entscheidung in Sachen der Alpgenossenschaft Roseg Samaden vom Januar 1881 ausge prochen. Sollte wirklich im vorliegenden Falle in der Gemeinde Scheid keine unparteiische Polizeikommission konstituirt werden können, wie Rekurrent behaupte, so hätte einfach der Kleine Rath für die Konstituirung einer unparteiischen Kommission zu forgen. Von einer Anerkennung des civilrichterlichen Forums durch die Gemeinde sodann könne offenbar, da die Gemeinde eine förmliche Widerklage gar nicht erhoben habe, keine Rede fein. Daher werde auf Abweisung des Rekurses unter Kosten folge angetragen. Das Bundesgericht zieht in Erwägung:
den, gewisse allgemeine Regeln autonomisch festzustellen, statuirt, keineswegs dagegen eine richterliche Befugniß der Gemeindebe hörden begründet. Demnach hat das Bundesgericht erkannt: Der Rekurs wird als begründet erklärt und es wird demnach der angefochtene Beschluß des Kleinen Rathes des Kantons Graubünden vom 24. September 1881 als verfassungswidrig aufgehoben.
