The Gotthard railway objected that the Arnold brothers had forfeited their expropriation appeal because they had not filed a proper written notice of claim within the statutory period. The Federal Court held that the notice, although orally made, was written down by the municipal clerk and therefore met the writing requirement. It further held that the notice sufficiently identified the expropriated property and the claimants, which was enough under Art. 12 No. 2 of the Expropriation Act. The objection was rejected, and the compensation was fixed according to the instructing commission’s proposal.
Art. 12 Ziff. 2 Gesetz betreffend die Verbindlichkeit zur Abtretung von Privatrechten; Anmeldung der abzutretenden Rechte; Schriftform und Bestimmtheit der Eingabe. Die Anmeldung braucht nicht vom Ansprecher selbst schriftlich verfaßt zu werden; es genügt, wenn sie der Gesellschaft schriftlich zukommt, auch wenn der Gemeindebeamte die Eingabe auf mündliche Anzeige hin aufnimmt. Entscheidend ist nicht die Formstrenge, sondern daß der Ansprecher sich bei zuständiger Stelle unzweideutig als Inhaber eines bestimmten, in Abtretung fallenden Rechtes zu erkennen gibt. Der Zweck der Anmeldung liegt in der Ermittlung der entschädigungsberechtigten Personen; eine ausdrückliche Erklärung des Entschädigungsbegehrens ist nicht erforderlich, sondern zu unterstellen (consid. 1-2).
