Braunschweig challenged the Schwarzenburg court's competence to hear Zurbrügg's counterclaim for defects in a horse sale, arguing that Article 59 BV required suit at the defendant's domicile and that the Vaud warranty rules imposed a short deadline. The Federal Court held that counterclaims may be brought before the court seized by the plaintiff when they are materially connected to the principal claim. Because both claims arose from the same sale, jurisdiction existed. The 1853 concordat concerned only substantive warranty liability, not forum. The complaint was dismissed.
Art. 59 BV; counterclaim jurisdiction and material connexity. A defendant is not barred by the constitutional forum of the defendant's domicile from asserting a personal claim by way of counterclaim before the court seised by the plaintiff, provided the counterclaim stands in material connexity with the principal claim and may also be raised as an objection thereto (consid. 2). Such connexity exists where both claims arise from the same legal transaction. A concordat regulating warranty for hidden defects in livestock sales governs only substantive liability and does not itself determine jurisdiction (consid. 3).
nicht aus und was das waadtländische Gesetz betreffe, so sei dasselbe im vorliegenden Falle nicht maßgebend, weil der ganze Rechtsstreit der bernischen Jurisdiktion unterliege. D. Ueber dieses Erkenntniß beschwerte sich Braunschweig beim Bundesgerichte, indem er anführte:
dasselbe in den Fall, zu erkennen, inwieweit das Konkordat oder bernisches oder waadtländisches Recht zur Anwendung komme. Das Bundesgericht zieht in Erwägung:
