Schwab und Comp., represented by Fürsprech Jäger, complained to the Federal Court after the St. Gallen government refused to execute a final cantonal judgment clause that had opened recourse against the Kornhausverwaltung in Rorschach and Näf-Walser. The Federal Court held that Art. 55 of the cantonal constitution was merely an organizational provision on enforcement and did not guarantee execution in every case. It further held that questions about the scope of res judicata under cantonal civil procedure were for the cantonal authorities unless there was manifest arbitrariness. The complaint was dismissed.

The constitutional clause empowering the government to execute final judgments is an organizational competence norm, not a direct guarantee of execution in every case. Federal review is available only where the refusal to execute is arbitrary and thus amounts to a denial of justice. The scope and effects of res judicata under cantonal civil procedure, including its binding force toward persons joined by notice of litigation, are in principle matters of cantonal law; the Federal Court intervenes only in case of manifestly untenable interpretation (consid. 2-3).

Der Staat sei daher im Recht gar nicht vertreten gewesen, woraus folge, daß dem Bezirksgericht Rorschach die Kompetenz gemangelt habe, ein Urtheil gegen den Staat aus zufällen.
