The Federal Court held that Widow Sutter’s appeal against the Basel-Stadt appellate judgment was time-barred. The cantonal judgment had been validly communicated when the claimant’s representative was summoned to and attended the publication hearing on 5 September 1878. The appellant’s later claim that her lawyer only informed her on 28 September did not postpone the federal 20-day deadline. Because she was indigent and had received legal aid below, the court waived costs.

Where federal law leaves notification of the cantonal judgment to cantonal procedure, the judgment is deemed communicated when, under cantonal law, the parties or their representatives have been duly summoned to and have attended the publication hearing. The subjective date on which counsel actually informs the party is irrelevant to the peremptory federal time limit. The appeal is therefore inadmissible if filed after expiry of the statutory period (consid. 1–3). Costs may be waived for an indigent party who cannot bear litigation expenses and has already benefited from legal aid (consid. 4).
