Zusammenfassung

Schmid and Oegger were ordered by the District Court of Zofingen to comply with a creditors’ manifestation request in the bankruptcy of August Lüthi & Co. They filed both a cantonal appeal and a federal constitutional complaint alleging breach of Arts. 58 and 59 of the Federal Constitution. The Federal Court held that they were not obliged to exhaust the cantonal appeal first, but since they had chosen to do so, it would not decide the federal complaint before the Aargau Cantonal Court of Appeal had ruled. The complaint was therefore not entertained for the time being.

Art. 59 BV; constitutional complaint against a cantonal judgment and concurrent ordinary cantonal appeal: the Federal Court may be seized directly without prior exhaustion of the cantonal appellate instance, but if the complainant has in fact invoked the ordinary cantonal remedy, the Federal Court will ordinarily stay out of the matter until the cantonal appellate judgment has been rendered; the complaint is then not entered into for the time being (consid. 1).

  1. Urtheil vom 13. Dezember 1878 in Sachen Schmid und Oegger. A. Durch Urtheil des Bezirksgerichtes Zofingen vom 26. Juni 1878 wurden S. C. Schmid in Adelboden und Joh. Oegger in Reiden auf die Klage der im Geldstage des August Lüthi und Komp. in Zofingen betheiligten Gläubiger schuldig erklärt, dem Manifestationsbegehren der letztern vor Bezirksgericht Zo fingen Folge zu leisten. B. Gegen dieses Urtheil ergriffen Schmid und Oegger Rekurs sowohl an das aargauische Obergericht als an das Bundesge richt, bei letzterm unter der Behauptung, daß dasselbe die Art. 58 und 59 der Bundesverfassung verletze. C. Gestützt darauf, daß Rekurrenten auch an das aargauische Obergericht gelangt seien, verlangten die Rekursbeklagten, daß auf die vorliegende Beschwerde so lange nicht eingetreten werde, bis das aargauische Obergericht entschieden habe. zirksgerichtliche Urtheil die Appellation an das kantonale Ober gericht zu ergreifen, sondern konnten die Beschwerde wegen Ver letzung des Art. 59 der Bundesverfassung direkt, mit Umgehung des kantonalen Instanzenzuges, hierorts anbringen. Nachdem sie aber gegen jenes Urtheil sich auch des ordentlichen Rechtsmit tels der Appellation bedient haben, ist für das Bundesgericht zur Zeit keine Veranlassung vorhanden, auf die Beschwerde ein zutreten, sondern ist vorerst das Urtheil des aargauischen Ober gerichtes abzuwarten. Demnach hat das Bundesgericht erkannt: Auf diese Beschwerde wird zur Zeit nicht eingetreten.
