The intestate heirs of Anton Grab sought reversal of the Zug appellate judgment upholding the validity of a will made in Walchwyl in 1875. They argued that the testator, then domiciled in Schwyz, lacked testamentary capacity under Schwyz law and that Art. 46 BV required application of the law of the domicile at the time of the will. The Federal Court rejected the appeal. It held first that Art. 46 BV was not yet in force because it awaited implementing legislation. In any event, the Zug court had applied the law of the place of domicile, and any alleged misapplication of that cantonal law was not reviewable at federal level.

Constitutional provisions whose execution is entrusted to federal legislation are not directly applicable before enactment of such legislation (consid. 1). Even if invoked, Art. 46 does not permit federal review of the correctness of a cantonal court’s interpretation and application of the competent cantonal law once that court has applied the law of the domicile/place of jurisdiction to the validity of a testament (consid. 2).
Bürger und Niedergelassener des Kantons Schwyz gewesen, ver stoße das Urtheil gegen Art. 46 der Bundesverfassung. Rekur renten stellten demnach das Gesuch, es möchte das Urtheil des Obergerichtes von Zug als im Widerspruch mit dem cit. Art. 46 stehend aufgehoben werden. C. Namens des verstorbenen A. Grab und dessen Wittwe trug Fürsprecher I. Stadlin auf Abweisung des Rekurses an, im Wesentlichen gestützt darauf, daß a. der Art. 46 der Bundesverfassung zur Zeit noch nicht in Kraft bestehe, weil das in demselben vorgesehene Ausführungs gesetz noch nicht erlassen sei; b. es sich in concreto nicht um die civilrechtlichen Verhält nisse von Niedergelassenen, sondern um diejenigen eines Bürgers handle; c. die Frage, ob der Zuger Richter schwyzerisches oder zuge risches Recht gegebenen Falls habe anwenden müssen, lediglich von den kantonalen Gerichten zu beurtheilen gewesen sei und für das Bundesgericht nicht in Betracht komme.
