Renggli and his wife challenged Lucerne enforcement measures after he alleged he had moved to La Chaux-de-Fonds. The Federal Court held that the enforcement had already been initiated in Lucerne while he still lived there, so his later departure could not defeat the Lucerne proceedings. It further held that the federal constitutional rule on the debtor’s forum did not permit changing the forum by moving during pending enforcement. The court also upheld the preventive ban on removing the wife’s furniture, leaving her to assert ownership through vindication in bankruptcy. The complaints were dismissed as unfounded.
Art. 59 BV; Art. 1 luzernisches Schuldbetreibungsgesetz: Once enforcement has been validly initiated at the debtor’s domicile, a subsequent change of domicile to another canton does not divest the originally seized authority of competence to continue the proceedings. The constitutional forum guarantee protects the debtor’s forum at the time proceedings are commenced, but does not authorize manipulation of venue by later relocation. A cantonal rule on domicile changes is, absent contrary wording, limited to intra-cantonal shifts. Where an attachment is validly maintained, provisional prohibitions against removal of attached movables are permissible; third-party ownership claims are to be asserted by vindication in the bankruptcy proceedings, with proof governed by ordinary proceedings if disputed.
D. Der Bezirksgerichtspräsident von Luzern trug auf Ab weisung beider Beschwerden an. Er bezog sich im Wesentlichen auf die Begründung der rekurrirten Schlußnahmen und fügte noch bei:
überlassen, die ihr zugehörigen Gegenstände im Konkurse ihres Ehemannes zu vindiziren. Demnach hat das Bundesgericht erkannt: Die Beschwerden sind als unbegründet abgewiesen.
