Bloch appealed against the Lucerne cantonal judgment dismissing his claim for CHF 2,000 damages arising from Banz’s alleged non-performance of a land sale. The Federal Court held that claims for damages from a real-estate sale are governed by cantonal law under Art. 231 OR. Since the dispute depended exclusively on cantonal law, it was outside federal appellate jurisdiction under Art. 56 OG. The court therefore did not enter into the appeal.

Where the claim for compensation is based on the alleged non-performance of a contract for the sale of immovable property, cantonal law governs both the existence and extent of any damages claim under Art. 231(1) OR. Such a dispute concerns exclusively cantonal private law and is therefore not cognizable by the Federal Court on appeal under Art. 56 OG (consid. 1).

In der Tat gilt für Kaufverträge über Liegenschaften nach Art. 231 Abs. 1 OR schlechthin das kantonale Recht folglich ist diefes allein auch dafür maßgebend, ob und in wel chem Umfange wegen Nichterfüllung eines Liegenschaftskaufver trages Entschädigungsansprüche geltend gemacht werden können. Die Streitsache entzieht sich daher gemäß Art. 56 OG der Kog nition des Berufungsrichters; erkannt: Auf die Berufung des Klägers wird nicht eingetreten.
