The seller challenged the dismissal of his action against the buyer’s claim for reimbursement of half the contribution paid for a road linked to the sold property. The Federal Court held that the promise of 7 March 1907 was made in direct connection with the land sale and functioned as a conditional reduction of the purchase price. It therefore followed the same legal regime as the sale of immovable property, namely cantonal law. Because no federal-law question was involved, the appeal was inadmissible and the Court declined to enter into it.
Art. 56 OG; admissibility of appeal and applicability of federal law in relation to an accessory undertaking connected with a real-estate sale: an obligation entered into contemporaneously with the sale and expressly in connection therewith is to be characterized according to its legal function. Where such undertaking constitutes in substance an adjunct, supplement or conditional modification of the purchase agreement, it shares the legal regime of the principal transaction. If the principal contract is an immovable-property sale governed by cantonal law, the accessory promise is likewise governed by cantonal law; the federal appeal is therefore excluded (consid. 1).
Feststellung der Vorinstanz, daß die Verpflichtung anläßlich des Kaufvertrages zu stande gekommen sei, als auch aus dem Wort laut der Verpflichtung selber, worin es heißt, die Erklärung des Klägers werde abgegeben im Anschlusse an einen heute ab geschlossenen Kaufvertrag usw. Die beiden Rechtsgeschäfte stan den aber nicht nur im engsten Zusammenhang, sondern es qua lifiziert sich die Verpflichtung geradezu als eine Ergänzung bezw. Modifikation des Kaufvertrages, da sie im Effekte auf eine bedingte Reduktion des Kaufpreises herauskam. Unter diesen Um ständen wird selbstverständlich jene Verpflichtung", welche mit dem Kaufvertrage steht und fällt, von dem gleichen Rechte be herrscht, wie dieser, also, da letzterer unstreitig ein Liegenschafts kauf war, vom kantonalen Rechte. Das Bundesgericht ist daher zur Anhandnahme der Berufung inkompetent; erkannt: Auf die Berufung wird nicht eingetreten.
