Arthur Stöcklin had received an assignment of book credits from Stöcklin Thüring before the company's bankruptcy. The bankruptcy administration refused to recognize the assignments, collected part of the receivables, and set Stöcklin a deadline under Art. 242 SchKG to assert his claim to the collected amount. The cantonal supervisory authority annulled the deadline, holding that Art. 242 SchKG did not apply. The Federal Supreme Court dismissed the administration's appeal, reasoning that the assigned receivables were not estate assets subject to vindication and that, regarding the collected CHF 1,106.30, no claim under Art. 242 SchKG existed in either factual scenario considered.
Art. 242 SchKG; scope of the deadline to assert a claim by a third party against the bankruptcy estate. The provision presupposes that the object in question is an estate asset subject to vindication. It does not apply where the bankruptcy administration contests an assignment by invoking avoidance under Arts. 286 and 288 SchKG, since the assigned receivables are then treated as having passed to the assignee and are not to be returned from the estate under Art. 242 SchKG. Nor does Art. 242 SchKG cover a claim to collected funds paid by third debtors: if payment to the estate was ineffective, the assignee remains creditor; if notice of assignment is unproven, the assignee may at most have a claim in unjust enrichment against the estate, which is not a vindication claim within Art. 242 SchKG (consid. 1-2).

Juli 1908: die Beschwerde werde im Sinne der Erwägungen gutgeheißen und demnach die Fristansetzung vom 17. Juni 1908 aufgehoben. In den Erwägungen kommt sie zu dem Ergebnis: Art. 242 finde nicht Anwendung, da es sich um keinen Aussonderungsanspruch, sondern um eine Masseschuld handle. Damit sei nicht gesagt, daß die Masse gegen den Rekurrenten klagen müsse; vielmehr bleibe dem Beschwerdeführer die Klägerrolle; nur dürfe ihm die Kon kursverwaltung keine Klagfrist ansetzen. C. Diesen Entscheid hat nunmehr die Konkursverwaltung recht zeitig an das Bundesgericht weitergezogen mit dem Antrage, ihn aufzuheben und die Fristansetzung vom 17. Juni zu schützen.
