Art. 45 BV; domicile certificates for minors; parental consent. The duty of the home authorities to issue a Heimatschein or equivalent document applies only to persons entitled to free settlement. Minors are excluded from this category because they cannot independently determine their place of residence; in this respect, the will of the holder of parental authority is decisive (consid. 2). A minor may therefore obtain such documents only with the consent of the person exercising parental authority. In the absence of such consent, refusal by the home authority is lawful. Questions of standing need not be examined where the complaint is unfounded on the merits.
