Müller appealed a Solothurn cantonal judgment in a lease dispute, seeking specific performance, weekly delay compensation, and alternatively CHF 2,000 for non-performance. The Federal Court held that the value in dispute was determined by the plaintiff's own quantified alternative claim of CHF 2,000, less the CHF 550 already admitted by Burkhardt, leaving only CHF 1,450. It further held that claims pleaded for different eventualities may not be added together. The appeal was therefore not admissible.

Where the plaintiff, in a claim for performance, expressly quantifies the interest in non-performance by requesting a specific sum as substitute relief, that amount governs the calculation of the value in dispute, subject to deductions for amounts already admitted. Claims formulated for mutually exclusive eventualities cannot be cumulated to reach the jurisdictional threshold; in particular, a claim for delay compensation linked to eventual performance and an alternative damages claim for total non-performance are not additive (consid. 1-2).
