The Federal Court examined ex officio whether the statutory amount in dispute under Art. 59 OG was met in an appeal concerning rescission of a horse exchange and daily compensation. It held that the horse could not be valued above the amount pleaded in the complaint, and that the daily compensation ran only from the reduced date stated in the claim until the first-instance main hearing. The total amount in dispute reached only CHF 1,760, below the federal threshold. The appeal was therefore not entered upon.
Art. 59 OG; amount in dispute in an appeal against a civil judgment. The Federal Court examines ex officio whether the statutory threshold is reached. In assessing a claim for periodic daily compensation for non-performance of an obligation, the period begins only at the date maintained in the complaint after any reduction of the claim, and the relevant end point is the time of claim and answer before the first instance, respectively the main hearing where cantonal procedure so provides (consid. 1). The value of an item in dispute cannot be set higher on appeal than the amount alleged in the complaint. If the combined value of the principal claim and the recurring compensation does not attain the minimum amount, the appeal is inadmissible.
