Elsäßer and Müller challenged an Aargau supervisory decision that fined Elsäßer CHF 20 as a debt enforcement officer and ordered the file sent to the public prosecutor for investigation of alleged forgery and abuse of oath. The Federal Debt Enforcement and Bankruptcy Chamber held that disciplinary authority over debt enforcement officers lies exclusively with the cantons and that no federal remedy exists under the SchKG for such sanctions. It further held that the criminal liability of such officers is governed entirely by cantonal law. The appeal was therefore not entertained.
Art. 14 SchKG, Art. 17 and 19 SchKG; disciplinary and criminal responsibility of debt enforcement officers: The disciplinary power over debt enforcement officers belongs exclusively to the cantonal supervisory authorities. Art. 14 SchKG only regulates the substantive basis of liability; it does not create a federal remedy. In particular, the complaint procedure under Arts. 17 ff. SchKG is limited to official acts directed against parties in enforcement or bankruptcy proceedings and does not extend to disciplinary sanctions imposed on officials. The criminal liability of debt enforcement officers as such, and the procedural transmission of a file for criminal investigation, are governed entirely by cantonal law and fall outside federal supervisory jurisdiction (consid. 1-2).
C Entscheidungen der Schuldbetreibungs 676 suchung zu übermitteln, ob der Betreibungsbeamte und sein Stell vertreier die beiden Rekurrenten sich der Urkundenfälschung und des Mißbrauches des Amtseides schuldig gemacht hätten, steht die Anwendung von Bundesrecht überhaupt nicht mehr während vorher hinsichtlich des Art. 14 in Frage, sondern nur die jenige kantonalen Rechtes, da es sich hier um die vom SchKG ganz unberührt gelassene strafrechtliche Verantwortlichkeit der Be treibungsorgane und ihre prozessualische Geltendmachung handelt; erkannt: Auf den Rekurs wird nicht eingetreten.
