Art. 80 OG; divorce grounds may not be newly raised or transformed on appeal before the Federal Court; a party who, before the last cantonal instance, accepts the judgment and seeks its confirmation waives further reliance on an omitted specific ground. Likewise, a unilateral divorce request under Art. 47 ZEG cannot be converted into a joint request under Art. 45 ZEG in the federal instance, as this would constitute an inadmissible new claim (consid. 1-2). Where only the Art. 47 ZEG ground remains in issue, the court must examine whether the marriage is deeply and irreparably broken and whether the plaintiff spouse does not bear the exclusive or predominant fault; if so, divorce may be pronounced notwithstanding the other spouse’s consent (consid. 3).
