At Meyer's request, the Baselstadt enforcement office initiated debt enforcement against Urs Flury Schumacher and later lifted the seizure because the debtor had still been entered in the commercial register until 1 March 1902. The office then charged the seizure costs, including CHF 16.30 to Meyer. Meyer complained and sought a declaration that the fee claim was impermissible. The Federal Debt Enforcement and Bankruptcy Chamber held that enforcement fees are owed to the office once the act is performed and are not affected by a later annulment of the measure; any liability issue lies outside supervisory review.
