Friedrich Waldmeier challenged a supervisory decision annulling a forced-sale transaction. The Federal Debt Enforcement and Bankruptcy Chamber held that he had already received legally effective notice through letters from the Basel-Stadt enforcement office on 14 and 18 May 1900, which clearly informed him of the content and scope of the decision. Direct service by the deciding authority was not required. The federal ordinance of 24 December 1892 was considered only an organizational rule. Since Waldmeier appealed only on 29 November 1900, the recourse was time-barred and the court did not enter into it.
Art. 19 SchKG; commencement of the appeal period by notification of the contested decision. A legally effective communication of a supervisory decision does not require direct service by the deciding authority to the party; it is sufficient that the competent office whose act is the object of the complaint clearly informs the party of the content and scope of the decision in the course of its التنفيذ/implementation. The federal ordinance of 24 December 1892 is merely an organizational directive intended to secure clear notice, but does not exhaustively and mandatorily regulate the form of notification in all cases. Where the party already obtained full knowledge in this manner, the appeal period runs from that date (consid. 1).

Ges. betrachtet werden sollte. Da der Rekurrent den Weiterzug an das Bundesgericht erst am 29. November 1900 erklärt hat, so erscheint sein Rekurs nach dem Gesagten als verspätet; erkannt: Auf den Rekurs wird nicht eingetreten.
