A Zurich debtor challenged definitive debt enforcement based on a German default judgment. The Federal Supreme Court held that Art. 59 BV may be invoked even against foreign judgments when their enforcement is sought in Switzerland. It further held that agreeing on Berlin as place of performance did not amount to a waiver of the constitutional forum of domicile, and that a unilateral invoice clause designating Berlin as forum could not bind the debtor. The constitutional complaint was therefore upheld and the Zurich enforcement order annulled.
Art. 59 BV; international enforcement of foreign judgments and waiver of domicile forum. The constitutional guarantee of the judge at the domicile may be invoked also against a foreign judgment whose enforcement is sought in Switzerland (change of practice, consid. 1). An agreement on the place of performance does not, without more, constitute an agreement on jurisdiction or a waiver of the constitutional forum; such waiver must be express or necessarily follow from the circumstances (consid. 2). A unilateral forum clause on an invoice sent only after conclusion of the contract is ineffective and cannot create consent by silence (consid. 3).
staatsrechtlichen Rekurses an das Bundesgericht wegen Verletzung dieser letztern Verfassungsbestimmung. B. Nunmehr hat die Rekurrentin mit Eingabe vom 22. Sep tember 1900 diesen Weg des staatsrechtlichen Rekurses; an das Bundesgericht wegen Verletzung des Art. 59 B. V. ergriffen, mit dem Antrage: Die vom Audienzrichter des Bezirksgerichtes Zürich verfügte Rechtsöffnung sei aufzuheben und die pendente Betreibung zu sistieren. Sie bemerkt dabei speziell, der einseitige Vermerk auf der Faktur, daß der Gerichtsstand in Berlin sei, vermöge diesen Gerichtsstand nicht zu begründen. C... D. Die Nekursbeklagte trägt auf Abweisung des Rekurses an. Sie macht unter Berufung auf das bundesgerichtliche Urteil vom 3. Juni 1878 in Sachen Kobelt geltend, Art. 59 B. V. könne gegenüber den Urteilen ausländischer Gerichte nicht zur Anwen dung gebracht werden, und führt im fernern aus, eine Anerken nung des Gerichtsstandes Berlin liege in der Annahme der Be stellscheine, die den Vermerk tragen: Zahlungs und Erfüllungs ort Berlin , eventuell in der Unterlassung eines Protestes gegen den Vermerk auf der Faktur, daß in Berlin der Gerichtsstand sei.
