The Federal Court held that a civilly liable third party who is not prosecuted as a criminal accused cannot be drawn into the criminal case for adhesion claims at the forum of the criminal proceedings. Surdez, domiciled in Geneva when first summoned, remained entitled to the protection of Art. 59 BV. His failure to appear before the Bernese court did not constitute waiver of the constitutional domicile forum. The appeal was therefore allowed and the lower judgment annulled as to him.

Persons who are not themselves subject to the criminal charge, but are pursued only for civil liability arising from the offense, enjoy the protection of the domicile forum and must be sued before the judge of their residence. The pendency of the criminal proceedings before that person was first summoned is irrelevant if the proceedings did not then concern him personally. Nor does failure to comply with a summons addressed to a constitutionally incompetent court amount to submission or waiver of the privilege of domicile (consid. on Art. 59 BV).

Teissier) der ad häsionsweisen Verfolgung von Civilansprüchen gegen Dritte, von der Strafklage nicht betroffene Personen entgegen und zwar inso fern, als solche Personen für Ansprachen im Sinne des Artikels wie eine derartige hier unzweifelhaft vorliegt, vor dem Richter ihres Wohnsitzes zu belangen sind. Mit Grund hält ferner Rekurrent für bedeutungslos, daß das fragliche Strafver fahren bereits während seiner Niederlassung in Biel hängig war, da es ihn damals in keiner Weise berührte; und ebenso kann daraus, daß Rekurrent der Vorladung vor den verfassungsmäßig unzuständigen Richter keine Folge gab, nicht auf eine Aner kennung des bernischen Gerichtsstandes geschlossen werden (vergl. Entscheidung des Bundesgerichtes, Band X, Nr. 7 Erw. 2 i. S. Kopp). Demnach hat das Bundesgericht erkannt: Der Rekurs wird begründet erklärt und das Urteil des kor rektionellen Richters von Nidau d. d. 8. Juni 1899, soweit es den Beklagten betrifft, aufgehoben.
