G. Wüest Peyer challenged a pledged-property foreclosure sale after the pledged assets were auctioned and a pledge-deficiency certificate and bankruptcy warning were issued. He relied on an alleged moratorium, lack of notice of the sale, and an unconsidered pre-auction offer. The Federal Court held that a claimed moratorium does not automatically stop enforcement; the debtor must seek judicial intervention under Art. 85. The complaints about notice and the offer were time-barred and, in any event, unfounded. The recourse was dismissed, and the challenged enforcement steps remained in force.

A moratorium asserted during the pendency of debt enforcement does not ipso jure suspend the proceeding; the debtor must apply to the judge for a stay or discontinuance under Art. 85 SchKG. Defects in notice of a sale must be raised within the ten-day complaint period of Art. 17 Abs. 2 SchKG, especially where the debtor had actual knowledge of the sale date. A pre-auction bid submitted solely to prevent the sale need not be considered by the enforcement office if not repeated at the auction; where cash payment is stipulated and not offered, the bid may be disregarded. If the sale stands, subsequent deficiency documentation and bankruptcy warning also stand.

Februar bereit erklärt, Stundung zu erteilen, wenn die Bürgen unter An gabe des Termins die schriftliche Einwilligung erteilten; diese Be dingung habe er, Wüest, durch Einsendung einer Erklärung der Bürgen vom 23. Februar, daß sie mit der Stundung bis zum
