Maggi Cie. enforced a debt against Jakob Schwarzenbach Barth. The Zurich enforcement office attached part of the daily wage earned by the debtor’s wife. The lower and upper cantonal supervisory authorities annulled the attachment, reasoning that only the debtor’s own wages could be seized. On federal appeal, the Court held that the wife’s challenge raised a substantive third-party ownership question falling outside supervisory competence and, in any event, that only the debtor could complain about non-attachability. The attachment was therefore reinstated.
Art. 91 and 93 SchKG; third-party claims and standing in attachment proceedings; the supervisory authorities are not competent to decide disputed civil-law ownership questions concerning the attached object. If a third person asserts that seized assets belong to the debtor under cantonal civil law, the issue must be resolved by the courts, while the attachment may proceed. A complaint based on total or partial non-attachability of the seized object is admissible only by the debtor himself; a spouse whose earnings are attached for the husband’s debts lacks standing to seek annulment on that ground.
