The Federal Court entertained the Waisenamt Altdorf's request to interpret its earlier damages judgment after finding the judgment incomplete rather than merely unclear. It held that no allocation had been made in the original proceedings, but that the later clarified procedural and family-law situation justified specifying the shares. The Court interpreted the CHF 7,000 award as belonging CHF 4,500 to the widow and CHF 2,500 to the children, with the children's portions further apportioned among the three children.

An interpretation request is admissible not only where the dispositive part is unclear or contradictory, but also where it is incomplete. If the original judgment left unresolved the internal allocation of a lump-sum award among several successful claimants, the Court may, on interpretation, specify the division on the basis of the facts underlying the judgment and the procedural situation, without reopening the merits. The allocation must be derived from the factual assumptions adopted in the judgment and from the parties' legal positions as they stood in the proceedings (consid. 1-2).
