Following a divorce judgment of the Thun court, the mother was awarded the children. Aargau authorities declined for the time being to decide on her enforcement request and waited for a custody-removal proceeding. The mother filed a constitutional appeal to the Federal Court, arguing that Aargau was causing unlawful delay and lacked jurisdiction. The Federal Court held that the children's domicile, and thus the competent authority for any removal of parental authority, was in Bern. It therefore found that the Aargau Government had no power to block enforcement and annulled its decision.
Art. 2, 4 Abs. 2, 9 Abs. 1 and 14 of the Federal Act of 25 June 1891 on the civil status of settled and resident persons; competence to remove parental authority and to impede enforcement follows the domicile of the person entitled to parental authority. Where the child is under parental authority, the child's domicile is that of the holder of parental authority. Only the authorities of that domicile canton are competent to decide on deprivation of parental authority; another cantonal authority may neither suspend nor obstruct enforcement of the divorce judgment on that ground. A cantonal supervisory authority acting ultra vires must have its decision annulled (consid. in fine).
Zu Folge des Schdunasurteils des Amtsgerichtes Thun wurde die Ausübung der elterlichen Gewalt über die Kinder des Karl Hartmann der Rekurrentin anvertraut (vergl. 153 des Civilgesetz buches für den Kanton Bern). Die elterliche Gewalt bestimmt sich nun nach dem Rechte des Wohnsitzes (Art. 9, Abs. 1 des citierten Bundesgesetzes), und zwar gilt als Wohnsitz der in elter licher Gewalt stehenden Kinder der Wohnsitz des Inhabers der elterlichen Gewalt (Art. 4, Abs. 2, leg. cit.), vorliegend also Steffisburg (Kanton Bern). Zu erklären, ob der Rekurrentin die elterliche Gewalt zu entziehen sei, sind einzig die bernischen Behörden (Art. 2, leg. cit.) und zwar der Regierungsstatthalter in Thun (Art. 149 und 150 bern. Civilgesetzb.) kompetent. Demnach war der Regierungsrat des Kantons Aargau als kanto nale Obervormundschaftsbehörde nicht befugt, die Rekurrentin in der Ausübung ihrer elterlichen Rechte zu hindern und der Ge meinderat Villnachern kann sein Begehren um Entziehung der elterlichen Gewalt bloß beim Regierungsstatthalter in Thun stellen (Art. 14 des Bundesgesetzes vom 25. Juni 1891). Demnach hat das Bundesgericht erkannt:
