Emma Reuter sued Jean François Gaschen in Bern for paternity-related payments. Gaschen, domiciled in Solothurn, defaulted in the Bern proceedings and was condemned to pay confinement costs, compensation to the municipality, child maintenance, and costs. On federal appeal, he argued that Art. 59 BV required suit at his domicile. The Federal Court held that the claim was a personal civil action and that the Bern court lacked jurisdiction. The default and the resulting forfeiture of procedural rights did not constitute valid submission to a prorogated forum. The appeal was therefore upheld and the Bern judgment annulled.

A personal civil action must be brought at the defendant’s domicile if he is domiciled in another canton. The constitutional forum of domicile is violated when a cantonal court without domicile jurisdiction entertains the action. Mere default by the defendant, and the procedural forfeiture attached thereto under cantonal law, does not amount to submission to that court’s jurisdiction; a court that is constitutionally incompetent cannot acquire competence through its own default ruling (consid. 1-2).
kompetent, und es ist logisch unmöglich, daß durch eine von einem inkompetenten Gerichte ausgesprochene Verfügung dasselbe kompetent werden könnte. Hieraus also kann auf eine Einlassung des Rekurrenten auf die Klage der Rekursbeklagten überall nicht geschlossen werden. Worin aber sonst bei der Unthätigkeit des Rekurrenten gegenüber der Klagsvorladung eine Vereinbarung des bernischen Gerichtsstandes erblickt werden möchte, ist uner findlich. Demnach hat das Bundesgericht erkannt: Der Rekurs wird als begründet erklärt und demgemäß das angefochtene Urteil des Amtsgerichtes Bern vom 23. September 1896 aufgehoben.
