Alois Mangold challenged a wage garnishment of CHF 1.50 per week ordered for an alimony debt owed to Magdalena Lüdin. The cantonal supervisory authority had already upheld the garnishment and found no change in Mangold’s circumstances since an earlier decision. The federal Schuldbetreibungs- und Konkurskammer held that the extent to which wages are indispensable under Art. 93 is chiefly a factual discretionary assessment by the enforcement authority and the cantonal supervisory authority. Federal review is limited to cases of arbitrariness or denial of justice. Finding no indication of arbitrary discretion, it dismissed the complaint.
Art. 93 SchKG; Art. 19 B.G.; review of wage garnishment by the federal supervisory authority: the determination of the amount of wages indispensable for the debtor and family is primarily a matter of factual discretion of the enforcement authority, reviewed by the cantonal supervisory authority for appropriateness. The federal supervisory authority may intervene only if the cantonal authority has manifestly abused its discretion to the detriment of debtor or creditor, or if the decision is unlawful or entails denial of justice (consid. 1). Absent indications of arbitrariness, a complaint directed against the assessment of the attachable wage is inadmissible in substance and must be dismissed.
Aufsichtsbehörde habe seine Ausführungen betreffend Unzulänglich keit seines Lohnes nicht in Zweifel gezogen, so bietet für eine solche Annahme der Umstand allein, daß in den Erwägungen dieser Aufstellung nicht Erwähnung getan ist, nicht genügend Handhabe. Aus diesen Gründen hat die Schuldbetreibungs und Konkurs kammer erkannt: Der Rekurs wird als unbegründet abgewiesen.
