The parties disputed ownership of the Pätschenwald and the validity of a settlement fixing boundaries. The cantonal court upheld the plaintiff's claims. On further appeal, the defendant argued the settlement was invalid and sought federal review. The Federal Court held that the dispute concerned real property rights and the validity of a settlement relating to immovable property, both governed by cantonal law. It therefore found no federal jurisdiction and refused to enter into the appeal.
Cantonal law governs disputes concerning ownership of immovable property and the validity of settlements relating to such rights; the mere fact that a settlement was concluded to avoid litigation does not bring the matter within federal jurisdiction. Where the substantive dispute belongs to cantonal law, the Federal Court cannot review it as a federal-law matter (consid. 2).

Demnach hat das Bundesgericht erkannt: Auf die Weiterziehung des Beklagten wird wegen Inkompetenz des Gerichtes nicht eingetreten.
