In an expropriation dispute between Walther Thomann and the Nordostbahngesellschaft, the Federal Tribunal rejected Thomann’s request to increase severance damages for the left side of his parcel, relying on the experts’ finding that the embankment caused no additional disadvantage there. It also held that the railway could not compel takeover of the detached strip on the right, because Art. 5 of the Expropriation Act requires that the compensation exceed one quarter of the value of the entire property, not merely of the affected strip. The tribunal otherwise adopted the instruction commission’s draft judgment.
Art. 5 Expropriation Act; conditions for the expropriator’s right to demand takeover of a remaining parcel fragment; the quarter-value threshold is calculated by reference to the value of the entire property from which the right was detached, not merely the value of the separated strip. Restrictions on ownership in expropriation matters are to be construed restrictively. In assessing local severance damage, the Federal Tribunal is bound in practice primarily by the findings of on-site experts and the instruction commission, unless the contrary is shown convincingly (consid. 1-2).

Hier wird wörtlich gesagt, daß der Wert des gesammten Besitztums, von welchem das enteignete Recht abgetrennt worden ist (la valeur des biens, dont ce droit a été détaché) in Betracht kommen müsse. Wäre übrigens auch das Gesetz nicht so klar, so müßten dennoch derartige Beschränkungen des Eigentumsrechtes in restrik tivem Sinne ausgelegt werden. Demnach hat das Bundesgericht erkannt:
