The defendants appealed to the Federal Court against an Uri cantonal judgment that had upheld a claim for part of a land-sale balance. They argued that the debt had been paid or forgiven as a gift. The Federal Court first separated the jurisdiction issue and held that the alleged gift-like remission was governed by cantonal law under Art. 141 OR, so it could not review the cantonal assessment. It therefore refused to enter into the appeal for lack of competence and left the Obergericht judgment intact.
Art. 141 OR; federal review of alleged gratuitous remission of a claim: the question whether a debt was released as a gift is governed by cantonal law, not federal law. The existence of donative intent on the creditor's part is thus a matter for the cantonal authorities and escapes federal appellate review. Where the only substantive objection concerns such gift-like remission, the Federal Court lacks competence to examine the merits; the cantonal factual findings, in particular on the absence of actual payment, remain binding (consid. 2).
Forderung total abzuweisen. Bei der heutigen Verhandlung wird nachdem der Anwalt der Kläger und Rekursbeklagten angemeldet hat, daß er die Kompetenz des Bundesgerichtes zu bestreiten ge denke, beschlossen, die Verhandlung über die Kompetenzfrage von derjenigen über die Hauptsache zu trennen. Der Anwalt der Kläger begründet darauf hin den Antrag, es wolle das Bundes gericht sich in Sachen inkompetent erklären und daher auf die Weiterziehung der Gegenpartei nicht eintreten.
