Louise Brunner challenged a cantonal decision that refused to hand over a mortgage security deed ordered by prior civil judgments. The Federal Court held that the refusal was not a mere execution detail but, in substance, a precautionary measure linked to anticipated guardianship proceedings. Because such matters fell within judicial, not administrative, competence, the cantonal authorities exceeded their powers and violated the separation of powers. The appeal was upheld and the Regierungsrat's decision was annulled.

A refusal by a mere enforcement authority to hand over a deed, when justified by the prospect of guardianship proceedings and intended to maintain the status quo, is in substance a precautionary measure. Such a measure cannot be ordered by an administrative authority. Where no guardianship request is yet pending, a fully capable person may not be restricted in the exercise of disposition by administrative action; doing so constitutes a usurpation of judicial competence and violates the constitutional principle of separation of powers (consid. 1-2).
argauischen Civilgesetzbuches, deren Zweck die Aufrechthaltung des status quo während des vormundschaftlichen Verfahrens hätte sein sollen. 2. Hiezu war aber eine bloße Vollziehungsbehörde nicht kom petent. Es ist vielmehr anzuerkennen, daß auf Grund der Art. 53 und 55 der aargauischen Staatsverfassung in Verbindung mit 29 des Gesetzes vom 16. März 1884 über Einrichtung der Sezirksämter alles dasjenige, was sich auf Bevogtigung oder Ent vogtigung bezieht, in die Kompetenz des Richters gehört, und deßhalb von einer bloßen Vollziehungsbehörde nicht verfügt werden kann. Die gleiche Bestimmung stellt auch 275 des bürgerlichen Gesetzbuches auf. In concreto kommt sodann noch der Umstand hinzu, daß damals ein Bevormundungsbegehren noch nicht ge stellt war und somit eine nach dem Bundesgesetz vom 22. Juni 1881 vollständig handlungsfähige Person auf verfassungswidrigem Wege in ihrer Verfügungsgewalt beschränkt worden ist. Insoweit ist also der Vorwurf der Kompetenzanmaßung begründet und da Art. 3 der aargauischen Staatsverfassung den Grundsatz der Ge waltentrennung aufstellt, so ist damit diese Verfassungsbestimmung verletzt. Demnach hat das Bundesgericht erkannt: Der Rekurs wird als begründet erklärt, und der Entscheid des Regierungsrathes des Kantons Aargau vom 6. August 1891 aufgehoben.
