Nidwalden challenged Thurgau's refusal to surrender two minor children for guardianship arrangements in Beckenried. The Federal Court held that the children were actually residing in Thurgau when Nidwalden ordered guardianship, and that, in the absence of a binding concordat, the canton of residence has guardianship jurisdiction. Since Thurgau had withdrawn from the 1822 guardianship concordat, it was not bound to enforce Nidwalden's measures. The recourse was dismissed.
Art. 46 B.V.; guardianship jurisdiction in inter-cantonal conflicts; territorial principle. So long as Art. 46 B.V. had not been implemented by federal legislation and no treaty or concordat applied, each canton was entitled to subject persons domiciled on its territory to its guardianship authorities. In a conflict of competence, the power to decide on guardianship belonged to the canton of residence, not the home canton (consid. 2). A concordat on guardianship and guardianship relations does not bar application of this principle where a participating canton validly withdraws from the concordat; the former concordat no longer governs relations with that canton (consid. 3).
