The Federal Court rejected Hübscher's challenge to a Schaffhausen district court judgment sentencing him to two days' imprisonment for self-caused insolvency after non-payment of a small debt. It held that the complaint was not time-barred because a debtor may challenge the enforcement of a debt-imprisonment sentence even after the usual deadline. On the merits, the Court ruled that the 1887 statute treats self-caused insolvency as a public offense punishable by imprisonment and not as unconstitutional debt imprisonment. The complaint was dismissed.

Debt imprisonment is abolished and may no longer be executed, even with the debtor's consent; a debtor may therefore still object to the enforcement of a judgment ordering imprisonment for debt. By contrast, the statutory punishment of self-caused insolvency under the Act of 1 June 1887 constitutes a public-law penalty for a delict, dependent on a finding of fault and no longer avoidable by payment of the debt or withdrawal of the complaint by the creditor. The fact that prosecution is initiated only on request does not alter the penal character of the measure (consid. 1-2).

Demnach ist die Beschwerde als unbegründet abzuweisen; denn es ist in casu genau nach dem Gesetze verfahren, insbesondere das Verschulden des Rekurrenten vom Gerichte geprüft und festgestellt worden. Demnach hat das Bundesgericht erkannt: Die Beschwerde wird als unbegründet abgewiesen.
