The Federal Court examined ex officio whether the plaintiff's appeal complied with the 20-day period of Art. 30 OG. It held that the challenged judgment had been served on 1888-05-16, as certified by the cantonal court office, and that the appeal declaration reached the court only on 1888-06-06. Because the declaration must be filed with the competent cantonal court within the deadline, the appeal was late. The Federal Court therefore did not enter into the matter and left the Luzern High Court judgment unchanged.
Art. 30 OG; timeliness of appeal to the Federal Court. The statutory twenty-day period is peremptory and must be examined ex officio. The appeal is only timely if the declaration is lodged with the competent cantonal court within the deadline; neither signature nor dispatch by post suffices. Proof of service by official certificate prevails over a contrary assertion by the appellant. An appeal filed on the 21st day after notification is inadmissible and is not examined on the merits (consid. 1-2).

Demnach hat das Bundesgericht erkannt: Auf die Weiterziehung der Klägerin wird als verspätet nicht eingetreten, und es hat demnach in allen Theilen bei dem an gefochtenen Urtheile des Obergerichtes des Kantons Luzern vom 25. April 1888 sein Bewenden.
