Heinrich Müri challenged an Aargau Obergericht decision that applied Art. 510 OR to a suretyship from 1873 and treated the debtors' objection as potentially freeing them if the creditor had failed to notify them of the principal debtor's bankruptcy. Müri argued that former cantonal law should have governed and that the court had violated constitutional equality and the principle of cantonal law remaining in force until validly replaced. The Federal Court held that the dispute concerned a debatable interpretation of federal obligations law, not a clear constitutional breach, and that no unequal treatment was shown. The complaint was dismissed.

A constitutional grievance arises only where a cantonal court, by relying on inapplicable federal provisions, clearly displaces still-valid cantonal law or otherwise infringes the principle of federal supremacy/cantonal law in force. Where the temporal reach of the federal statute is arguable and the challenged decision rests on a permissible interpretive view, the Federal Court will not review the correctness of the interpretation as a state court. Equality before the law is not violated absent proof of arbitrary unequal treatment in comparable cases.

In ihrer Vernehmlassung auf diese Beschwerde führen die Rekursbeklagten aus: Eine Verletzung der vom Rekurrenten an gerufenen Verfassungsbestimmungen liege offenbar nicht vor; ebensowenig sei das Obligationenrecht verletzt worden, vielmehr beruhe die angefochtene Entscheidung, wie des nähern ausge führt wird, auf richtiger Auslegung und Anwendung der ein schlägigen Bestimmungen des Obligationenrechtes und entspreche der praktischen Rechtsauffassung, während die gegentheilige Mei nung komplizirt und unpraktisch sei und des innern Grundes entbehre. Demnach werde beantragt: Das Bundesgericht wolle:
