The Federal Court held that Johann Bigler's appeal against the Bernese Appellations and Kassationshof judgment was filed too late because the declaration reached the cantonal court only on the 21st day after service. Posting the letter one day earlier was insufficient. The Court further denied restitution, holding that the appeal deadline under Art. 30 O.G. is a mandatory public-interest time limit and cannot be restored merely because the opposing party consented. The conditional appeal by Rosine Lehmann therefore fell away, and the cantonal judgment remained fully in force.
Art. 30 O.G.; timeliness of appeal declaration and restitution against missed appeal deadline. The appeal under Art. 29 O.G. must be declared before the cantonal court that rendered the judgment within the peremptory 20-day period; the declaration is only effective upon receipt by that court, not upon posting. The deadline is a mandatory time limit established in the public interest and is therefore not subject to disposition by the parties. Restitution under the Civil Procedure Code may, at most by analogy, be considered for excusable and duly proven impediment, but not merely on the basis of the opponent's consent (consid. 2-3).
