Friedrich Blösch brought a divorce action in Nidau, then sought to initiate conciliation proceedings in Chaux-de-Fonds and asked the Bern authorities to permit service of those summonses. The Bern Appellations and Kassationshof refused, holding that the Nidau proceedings were still pending and could not be ended unilaterally against the wife's will. On federal constitutional appeal, the court held that no judicial ruling had yet determined whether the Nidau action could be withdrawn. The complaint was therefore premature and was dismissed.
Art. 43 of the Federal Act on Civil Status and Marriage; divorce forum and premature constitutional complaint against refusal of service. The place-of-domicile forum in divorce matters is exclusive and cannot be altered by agreement; however, where a party has already seised one court, the question whether that instance has been validly withdrawn must first be decided by the court first seized. Until such judicial determination exists, a constitutional complaint against refusal to authorize a further summons to another court is premature (consid. 1).
Bern, rechtshängig gemacht worden ist. Die angefochtene Ent scheidung des Appellations und Kassationshofes des Kantons Bern beruht nun auf der Erwägung, daß so lange die dadurch begründete Instanz nicht beendigt sei, eine neue Ladung vor ein anderes Gericht als unzuläßig erscheine, und daß, beim Widerspruche der Beklagten, der Rekurrent nicht ohne weiters, durch einseitige Erklärung, die von ihm selbst eingeleitete Instanz beendigen könne. Dagegen ist durch die fragliche Ent scheidung nicht ausgesprochen worden, daß der Rekurrent seine Klage bei dem Gerichte in Nidau überhaupt nicht zurücknehmen könne, sondern der Appellations und Kassationshof stellt blos fest, daß in erster Linie, bevor eine Ladung vor ein anderes Gericht erfolgen dürfe, der vom Rekurrenten selbst angerufene bernische Richter über die Statthaftigkeit der Zurücknahme der Klage zu entscheiden habe, das heißt daß nur durch eine solche rich terliche Entscheidung die Instanz beendigt werden könne. Der Rekurs ist demnach offenbar verfrüht. Denn eine richterliche Entscheidung, daß der Gerichtsstand in Nidau begründet sei und der Prozeß dort zu Ende geführt werden müsse, liegt noch gar nicht vor und es kann demnach von einer Verletzung des Art. 43 des Bundesgesetzes über Civilstand und Ehe resp. des Prinzips, daß der in dieser Gesetzesbestimmung aufgestellte Ge richtsstand des Wohnortes ein ausschließlicher, durch Parteiver einbarung nicht abänderlicher sei, gegenwärtig noch nicht gesprochen werden. Demnach hat das Bundesgericht erkannt: Der Rekurs ist abgewiesen.
