The reopening of a finally discontinued criminal investigation is part of the intermediate procedure and falls within the competence of the authority that ordered the discontinuance; the trial court itself is not competent. If the court considers that grounds for reopening exist, it must suspend the proceedings and invite the prosecution to initiate reopening. Art. 166 StPO governs the first-instance main hearing and is not directly transferable to appeal proceedings; newly discovered offenses before the appellate court require an assessment in light of the connection with the original referral and the seriousness of the new offenses.
