Hinsichtlich der der Offizialmaxime unterliegenden Ansprüche (so der Anspruch auf Kinderunterhalt und andere Kinderbelange) hat der Eheschutzrichter dagegen - nicht anders als der Scheidungsrichter - eine autoritative Anordnung in Urteilsform zu treffen (die materiell dem von den Eltern in der Vereinbarung gestellten gemeinsamen Antrag entsprechen kann). 3 Art. 279 und 287 Abs. 3 ZGB Das mit der Unmündigenunterhaltsklage befasste Gericht, das sich mit der Genehmigung einer zwischen dem Kinderbeistand und dem Vater geschlossenen Unterhaltsvereinbarung begnügt, ohne die Kindesmutter angehört zu haben, begeht dieser gegenüber eine Gehörsverletzung.
