45 Steuerfreie Übertragung der stillen Reserven bei Umwandlung (§ 20 StG).

II/2/c). Entscheid des Verwaltungsgerichts, 2. Kammer, vom 17. Mai 2001 in Sachen Erben M.G. gegen Entscheid des Steuerrekursgerichts. Sachverhalt A. E.B., der einen Landwirtschaftsbetrieb geführt hatte, verstarb am 10. Dezember 1964. Als gesetzliche Erben hinterliess er seine 7 Geschwister M.G.-B., W.B., A.B., E.B., E.E.-B., W.B. und F.B. In seinen Nachlass fielen verschiedene Liegenschaften, die zu seinem Geschäftsvermögen gehört hatten. A.B. starb am 10. Dezember 1966 und hinterliess die anderen 6 Geschwister als gesetzliche Erben. Diese unterzeichneten am 11. Juli 1967 einen Teilungsvertrag (partielle Erbteilung). Darin wurde festgehalten, seit dem Tod von E.B. hätten F.B. und A.B. das Heimwesen pachtweise bewirtschaftet, seit Dezember 1966 F.B. allein. Alle Erben verzichteten auf eine Zuteilung nach Massgabe des bäuerlichen Erbrechts. An der Hofparzelle wurde F.B. eine lebenslängliche unentgeltliche Nutzniessung eingeräumt; hinsichtlich dieses Grundstücks wurde die Erbteilung bis zum Tod von F.B. aufgeschoben.
