The Constitutional Court upheld a constitutional complaint against a challenged judgment. I.Die Beschwerdeführerin ist durch das angefochtene Erkenntnis im verfassungsgesetzlich gewährleisteten Recht auf Gleichbehandlung von Fremden untereinander (ArtI Abs1 Bundesverfassungsgesetz BGBl Nr 390/1973) verletzt worden.
Das Erkenntnis wird aufgehoben.
II.Der Bund (Bundesminister für Inneres) ist schuldig, der Beschwerdeführerin zuhanden ihrer Rechtsvertreterin die mit € 3.144,– bestimmten Prozesskosten binnen 14 Tagen bei sonstiger Exekution zu ersetzen.
